Time Out has always promised to serve its audience with integrity and honesty. The same is true now that we publish online. Time Out has developed these terms of service to demonstrate our firm commitment to privacy and to disclose our information-gathering and - sharing practices for the Restaurants, Pars & Pubs website at http://www.timeout.com/london/restaurants/ (the "site"). By subscribing to the site, you are accepting the practices described in these Terms of Service. Our site will develop and evolve over time, and these Terms of Service may change to reflect that.

These Terms of Service supplement the Time Out Privacy Policy at http://www.timeout.com/about/privacy.php and the Privacy Policy is incorporated into these Terms of Service. If there's a conflict between the Terms of Service and the Privacy Policy, these Terms of Service override.

The Time Out privacy promise

We are absolutely committed to protecting your privacy. We are also committed to the following: (1) We will not pass on any individual user details unless we have your prior consent; and (2) if we don't have your consent to pass on individual user details, we will only give advertisers aggregate statistics about the number of users and their traffic patterns. The information collected through this site is the property of Time Out and is transferable in an ownership change.

Personal information

Time Out requires your name, a valid e-mail address, credit card information and billing address before you can access the site. This information is stored on a secure server in an encrypted format; this means that even if a hacker were able to access our server (which we have taken pains to prevent), he or she would not be able to access your actual credit card number. Your credit card information is not shared with third parties, except in the secure transactions in which your credit card is charged with your prior consent. Your other personal information is not shared with third parties without your prior consent. You should protect your password to the site because it gives someone access to your account information, including the ability to change the log-in e-mail address, password and billing information - as well as the site content you've paid for.

Time Out keeps track of the number of visitors to the site, the pages they visit and how long they stay. In addition, Time Out collects information from visitors who click on tile advertisements so that we are able to measure interest in the various areas of our site and inform advertisers as to how many visitors have seen or clicked on their ad tiles. Time Out also uses search requests to allow ad tiles on our site to be targeted, in the aggregate, to the readers for whom they are most pertinent (e.g., when you search for Italian restaurants, you may see a sponsorship tile for an Italian restaurant).

We collect these kinds of aggregate user information for two main reasons: (1) to help us continually improve the service we offer; and (2) to sell advertisements on the site to appropriate banner advertisers. We currently have no plans to introduce pop-up style advertising to this subscription site. Time Out discloses this information to advertisers. Note that advertisers do not have influence over the editorial content or reviews that appear on the site.

Your right to decide how your personal information is used

Areas of our site that request personal information contain a box that, if checked, will enable Time Out to contact you for internal marketing purposes (e.g., to send you information about special offers and updates to the site). If you don't want your information to be used for any of these purposes, you should not check the box. If we ever request that you volunteer additional information, such as financial data or age - in an online survey, for example - your response will always be voluntary. In addition, there will always be a box for you to check if you choose to enable us to disclose such information to a third party. Your credit card information will never be disclosed to third parties, except in the secure transactions mentioned above.

Cookies and Time Out

After you log into our site, we use cookies to track your usage on our site. This ensures that you are a subscriber, and allows you to roam freely within our subscriber-based site without typing in a password to access each page. We do not track any of your activity as it relates to your individual movements throughout our site, only as an aggregate of data in conjunction with users to our site as a whole. Your movement is not tracked once you leave our site.

Site security

Your credit card information is transmitted to the credit card company via secure-socket layers, commonly known as SSL. We maintain an SSL certificate issued by Thawte. To verify that you are on a secure page when you order, you can look for the locked padlock in the corner of your browser window. In addition, the url for those pages begins with https.

Fees and payments

Your credit card will be charged the balance due immediately, unless you sign up during a special promotion, in which case your credit card will be billed as stated in the promotion. Partial and full refunds will not be issued. Annual subscriptions will be automatically renewed for the term initially purchased unless you notify us that you choose to cancel (if you want to cancel, modify your Profile page by logging in and clicking on Profile in the navigation bar). If we are unable to charge your credit card for any reason, then your access will be suspended and you will be sent an e-mail notifying you of the problem. Access will be restored as soon as we are provided with a valid credit card.

Limitations on use

Your responsibilities

Since the site is subscriber-based, we trust that our users will not share their user log-ins and passwords with others. Only one individual may access the site at one time using the same user log-in. We ask for your cooperation in keeping your log-in information private.

The content on the site is owned by Time Out. You may print out pages for your own personal, non-commercial use. You may not share this information with others electronically, except by way of the email a friend functionality built into the site. You may not repost information from the site to any e-mail lists, online forums, or sites of any kind (whether personal or commercial) without prior written consent from Time Out.

Time Out reserves the right to suspend accounts at any time without notice.

Time Out responsibilities

Time Out strives to present a fast, reliable site that works across multiple platforms. We cannot be responsible for problems that result from using an older browser. When technical difficulties arise, Time Out will aim to resolve such problems as quickly as possible, but will not issue credits for downtime caused by any technical problems. If you believe you have detected a technical problem, please contact us. Scheduled maintenance will usually take place when usage levels are at their lowest point; credit will not be issued for any downtime.

The restaurants and bars that appear on the site are reviewed by Time Out critics, who visit anonymously and pay for their own meals and drinks. You'll also see advertising tiles (it takes a lot of money to send people out eating and drinking on Time Out's tab). We'd like to emphasise that the advertisers have no control over editorial content and receive no special favours. No restaurant or bar has been included and/or given a favourable review because its owner advertises in the magazine, online or in any of the guides.
