ELIGIBILITY: Time Out New York Offers and Experiences A Year of Theater Sweepstakes (the “Sweepstakes”) is open to legal residents of the fifty (50) United States and the District of Columbia who are 18 years of age and older, who are physically located and reside in the United States or District of Columbia. Void in Puerto Rico and where prohibited. Employees, directors and officers, and their immediate families (spouse, parents, children, siblings, and their respective spouses), and their respective household members, of Time Out America, LLC (the “Sponsor”), its parent company, affiliates, subsidiaries, and divisions, advertising and promotion agencies and Buddy Media are not eligible to enter. Sweepstakes is subject to all federal, state, local, provincial and municipal laws. U.S. law governs this Sweepstakes. The Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, Facebook. By entering, you understand that you are providing your information to the Sponsor and not to Facebook. The information you provide will be used for administration of the Sweepstakes and in accordance with these Sweepstakes Official Rules.
SWEEPSTAKES TIMING: The Sweepstakes begins at 8:00:00 AM Eastern Time (ET) on June 25, 2012 and ends 4:59:59 PM ET on September 4, 2012 (the "Promotion Period”). One (1) prize package will be awarded in a random drawing from among all eligible entries received during the Promotion Period (“Grand Prize Random Drawing”).
HOW TO ENTER: You may enter the Sweepstakes by submitting your name and email address on the Time Out New York A Year of Theater Sweepstakes Page at www.timeout.com/newyork/a-year-of-theater. Limit one entry per person per entry method. Subsequent entries submitted by the same person via the same entry method will be void. Entries must be received by 4:59:59 PM ET on September 4, 2012 in order to be eligible for the Grand Prize Random Drawing. Entries that have been generated by a script, macro, bot or any other automated means will be deemed void. Entries that are mechanically reproduced, copied, illegible, late or inaccurate are void. Incomplete entries or entries not complying with these Official Rules are subject to disqualification, at the Sponsor’s sole discretion. Entries become the property of the Sponsor and will not be acknowledged or returned. Sponsor’s decisions are final on all matters relating to this Sweepstakes. If a dispute results as to the identity of an online entrant, it will be determined that the online entry was submitted by the authorized account holder of the email address from which the entry is made. Sponsor’s database clock will be the official timekeeping device for the Sweepstakes.
Sponsor is not responsible for late, lost, incomplete, illegible, damaged, or misdirected entries. Sponsor’s decisions are final on all matters relating to this Sweepstakes. Sponsor reserves all rights, including the right to edit, publish, use, adapt, modify, or dispose of any entry, proper names, likenesses, and photographs for advertising and promotional purposes in all media (including, but not limited to, the internet) without additional compensation, except where prohibited by law. If an entrant changes his/her email address after he/she enters the Sweepstakes, it is his/her sole responsibility to notify the Sponsor by (postal) mailing notice to Sponsor’s address (listed below) to be received by the end of the Promotion Period.
ALTERNATE METHOD OF ENTRY: To enter without registering to receive promotional e-mails from Time Out, send a 3x5 card with your full name, e-mail address & phone number to “A Year of Theater Sweepstakes” at Time Out New York, 475 Tenth Avenue, 12th floor, New York, NY 10018. Mail-in entry must be received by 4:59:59 PM ET on September 4, 2012 in order to be eligible.
DETERMINATION OF WINNER: Potential Grand Prize winner will be selected in a random drawing on or about September 4, 2012 from among all eligible entries received via both entry methods. The random drawing will be conducted by the Sponsor. Sponsor’s decisions are final on matters relating to this Sweepstakes. Potential winner will be notified by electronic mail and/or overnight or U.S. mail on or about September 4, 2012. Potential Grand Prize winner will be required to sign an affidavit of eligibility/declaration of eligibility/liability release and where legal, a publicity release, and for a U.S. resident, a Federal and State tax release, and return these documents, properly executed, within 48 hours of of issuance of notification. Non-compliance within this time frame or with the Official Rules, or if prize or prize notification is returned as undeliverable, will result in the entrant being disqualified, and the prize will be awarded to a potential alternate winner. Allow 3-4 weeks for booking of prize. Odds of winning a Grand Prize depend upon the total number of eligible entries received during the Promotion Period.
PRIZES: One (1) Grand Prize: Two (2) tickets to Detroit, two (2) tickets to End of the Rainbow, two (2) tickets to Picnic, two (2) tickets to The Mystery of Edwin Drood, two (2) tickets to Mamma Mia, two (2) tickets to Spider-Man: Turn Off the Dark, two (2) tickets to Rock of Ages, two (2) tickets to Fuerza Bruta, two (2) tickets to Rock of Ages, two (2) tickets to The Blue Man Group, two (2) tickets to Newsies, two (2) tickets to Mary Poppins. Shows are subject to change.
Any and all costs not expressly stated within this description are the responsibility of the winner. Winner will receive two tickets per month from September 2012-August 2013, all tickets are subject to availability and some restrictions and blackout dates may apply. Approximate retail value of Grand Prize: $2,544.
Approx. Retail Value of prize is reflected in U.S. dollars. All taxes and any other costs not specifically stated within these Official Rules are the sole responsibility of the winner. Prize may not be transferred, substituted or redeemed for cash, except at the Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize of comparable or greater value if advertised prize is unavailable at the time the prize is awarded. If winner is 18 years of age or older but deemed a minor in his/her state or place of residence, prize will be awarded in the name of a parent or legal guardian. Grand Prize winner must supply Sponsor with his/her social security number for tax purposes and winner will receive an IRS Form 1099 from the Administrator for the ARV of the Grand Prize (stated above) for the calendar year won.
CONDITIONS OF PARTICIPATION: By entering, entrants agree to be bound by these Official Rules including all eligibility requirements. Sponsor will collect information from the entrant for the purpose of administering the Sweepstakes, to notify the winner and for future communications and promotional emails about Time Out New York and Time Out New York Deals. Sponsor will not share this information with any third parties, except as necessary for the administration of the Sweepstakes or future communication about Time Out New York. Eligible Participants agree to receive future information from the Sponsor, its affiliates and prize providers. Sponsor’s use of information submitted by entrants in connection with this Sweepstakes will be subject to the terms and conditions stated in these Official Rules as well as to the Sponsor’s Privacy Policy available at www.timeout.com/newyork/privacy-policy. All materials submitted in connection with the Sweepstakes become the property of Sponsor and will not be returned. By accepting a prize, winner consents to the use of his/her name, image, likeness, photograph, voice and biographical material and entry submission for advertising, publicity and promotional purposes by Sponsor, or a party designated by Sponsor, in any and all media now or hereafter known including but not limited to, any online announcements, or for sharing this information with the press for viewing, whether TV or print, throughout the world in perpetuity, without additional compensation, notification or permission, except where prohibited by law. Entrants agree to abide by the terms of these Official Rules and the decisions of the Sponsor, which are final, and waive any right to claim ambiguity in these Official Rules. By participating and/or accepting a prize, entrants, Winners and guests agree to release and hold harmless the Sponsor, its advertising and promotion agencies and their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors, from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in Sweepstakes, or possession, acceptance and/or use or misuse of prize or participation in any Sweepstakes-related activity, including but not limited to any claims based on publicity rights, defamation or invasion of privacy and merchandise delivery. Sponsor shall not be responsible for any cancellations, delays, diversions or substitutions or omissions whatsoever by any transportation companies or any other persons providing any services to winner including any results thereof such as changes in services or location necessitated by same. Sponsor is not responsible if any part of a Sweepstakes prize cannot be awarded due to acts of god, acts of war, natural disasters, weather or acts of terrorism.
WINNERS' LIST: For the names of the winners, available after September 5, 2012, mail a self-addressed, stamped envelope by September 5, 2012 to: TONY Deals Survey Sweepstakes Winners, Attn: Marketing, 475 Tenth Ave, 12th Floor, New York, NY 10018.
