Terms and conditions for the Time Out and Warner Bros Fantastic Beasts competition

HOW TO ENTER

This photo competition (the ‘Competition’) is organised by Time Out England Limited (‘Time Out’) in association with Warner Bros. Pictures (“Prize Provider”). We want you to send us a photo you’ve taken that reveals something truly magical about your London.  Submit your photos by uploading your image from your computer or smartphone, via http://www.timeout.com/london/things-to-do/win-a-trip-for-two-to-nyc-to-see-fantastic-beasts-and-where-to-find-them, between 18th October 2016 and 26th October 2016 (DATE) for A mini break for two people to New York City, including flights, accommodation and tickets for the World Premiere of ‘Fantastic Beasts and Where to Find Them’.

HOW IT WORKS 

Complete your entry by submitting your photos, from which one winner will be selected by a panel of judges composed of Time Out commercial team.

GENERAL PHOTOCOMPETITION TERMS & CONDITIONS

1. Competition begins at midnight 18th October 2016 (the “Start Date”). Competition closes at 11.45pm on 26th October 2016 (the “End Date”).

2. The competition is open to all UK residents over the age of 18, except employees of Time Out and the Prize Provider.

3. Multiple entries will be accepted.

4. By uploading your photograph, you understand that you are entering the Competition and agree to these Competition rules (the “Rules”). Time Out reserves the right to exclude any entry from the Competition at any time if they have a reason to believe that the entrant has breached any of the Rules.

5. Copyright in all photographs submitted for this Competition remains with the respective entrants. However, entrants agree that by submitting a photograph to the Competition, they grant Time Out and the Prize Provider each a royalty free, perpetual irrevocable worldwide licence to use and republish their photograph(s). This includes displaying the photograph on www.timeout.com, sharing through social media and publication by both the Prize Provider and Time Out worldwide in any of their publications, their websites and/or in any promotional material. You agree that we may cut, edit or arrange your photograph(s) where appropriate to appear in print or on-line.

6. The winners will be notified by Time Out by telephone or email on or before 31st October.

7. The winner will be selected by a panel of judges composed of Time Out commercial team

8. All entries must be submitted by the original photographer of the photograph who must be the exclusive owner of all photographs submitted by him/her to the Competition.

9. The winner may be required to participate in publicity relating to the promotion which may include having his/her photograph taken for promotional and press purposes.

10. It is the responsibility of the entrant to obtain any publication rights and/or release rights before photographs are entered into the Competition. Time Out and the Prize Provider will not accept any responsibility for the publication of photographs which do not have publication rights and/or release rights cleared by the photographer. Publication rights and/or release rights may need to be cleared by the photographer if they include the names, likenesses, photographs, videos or similar of any individual without their express permission.

11. All photographs considered inappropriate or offensive by Time Out will be disqualified.

12. The Competition Prize Package will be provided by Warner Bros. Pictures and is subject to their terms and conditions available at this page only.

13. The winning photographs will be chosen by the Panel of Judges based on the photo which best reflects the magic within London .

14. Winners will be notified using the contact information they submitted when uploading their photograph. Winners may be asked to provide identification. Winners not contactable or who fail to return contact within 48 hours of notification after reasonable efforts have been made to contact them will be disqualified, they thereby forfeit their right to the prize, no compensation will be given and a reserve entrant will be selected as an alternative winner.

15. The names of the winners may be obtained by sending a written request with a stamped addressed envelope stating for which competition you would like winners’ details to Time Out England Limited, 4th Floor 125 Shaftesbury Avenue, WC2H 8AD London or by email to competitions@timeout.com by 26th November 2016.

16. The judges’ decision is final and binding on the entrants. No correspondence will be entered into.

17. The Prize Package is non-negotiable, non-transferable and non-refundable.

18. In the event of unforeseen circumstances Time Out and the Prize Provider reserve the right to substitute the Prize Package for an alternative of equal or greater value.

19. If an act, omission, event or circumstance occurs which is beyond the reasonable control of Time Out and/ the Prize Provider and which prevents Time Out and/ the Prize Provider from complying with these terms and conditions, neither Time Out and/ the Prize Provider will be liable for any failure to perform or delay in performing their obligations. Time Out reserves the right to modify, delay, postpone or cancel the Competition in the event of circumstances outside of its reasonable control.

20. This Competition and the Rules shall be governed by the laws of England and Wales and subject to the exclusive jurisdiction of the English courts.

21. By entering the Competition, all entrants consent to the processing of their personal data by Time Out for the purposes of administration of this Competition.

22. The Competition promoter is Time Out England Limited of 4th Floor 125 Shaftesbury Avenue, WC2H 8AD London and all references to Time Out shall mean Time Out England Limited. Time Out shall have the right to license all and any rights granted to Time Out to its associated companies and licensees and the Prize Provider.

SPECIFIC PRIZE TERMS & CONDITIONS

23. The Prize awarded to the winner of the Prize (the “Prize Winner”) of the Media Promotion will include:

- One (1) pair of tickets (one for the Prize Winner and one for their chosen guest (the “Guest”)) to the New York Premiere of the Film (the “Tickets”);

- Return economy flights between Heathrow Airport and John F Kennedy Airport in New York for the Prize Winner and the Guest;

- Three (3) nights’ 4-star bed and breakfast accommodation for two (2) persons at The Empire Hotel, New York City (the “Hotel”);

- Meet and greet return airport transfers from John F Kennedy Airport to the Hotel;

- and Travel insurance.

The Prize does not include:

- anything not detailed above;

- spending money;

- food or drink (besides the breakfasts provided by the Hotel);

- in the case of foreign travel, any arrangements regarding passports and visas; and/or

- the costs and expenses of anyone accompanying the Prize Winner and the Guest (including any parent or guardian that is required to accompany a child).

Additional Prize Terms and Conditions

24. The Tickets are for the Prize Winner and his/her Guest to attend the screening of the Film only. For the avoidance of doubt, the Tickets do not include access to the VIP area.

25. Dates of travel are Wednesday 9th – Saturday 12th November 2016;

26. The Hotel is based on two people sharing one room. The Hotel will take a credit card pre-authorisation or cash deposit to cover incidentals;

27. If the Prize Winner is under the age of eighteen (18) years, they must be accompanied by a guest who is aged eighteen (18) years or older. A Prize Winner under the age of eighteen (18) shall remain under the control and supervision of such guest at all times.

28. Once selected, the Guest may not be changed without the express consent of Warner, which Warner may grant or withhold in its sole discretion.

29. The Prize Winner and the Guest will not be admitted without a ticket or after the screening begins;

30. The Prize Winner and the Guest may be required to take part in reasonable post-competition publicity for Warner and may be filmed, photographed or otherwise recorded by Warner or other third parties for publicity and the Prize Winner and the Guest consent to the use of his/her personal data for such purposes.

31. The Prize Winner and the Guest will be required to sign a Prize Acceptance Form before the Prize is awarded. If the Prize Winner is under the age of 18 years, a parent or guardian may be required to sign a Prize Acceptance Form before the Prize is awarded.

32. The Prize Winner and the Guest must be in possession of valid passports and all applicable visas/permissions.

33. The Prize Winner and the Guest are responsible for registering with the US Visa Waiver Program. Please note: The United States requires that travellers entering the United States under the Visa Waiver Program (ESTA) hold an e-Passport if their passport was issued on or after 26th October 2006;

34. The Prize Winner and the Guest shall not (by use of cameras, audio/video recorders, smart phones, electronic devices or similar means), photograph or record, or cause to be photographed or recorded, or permit any person attending at guests’ invitation to photograph or record, any part of the screening of the Film.

35. There is no cash alternative to the Prize which are subject to availability, non-transferable, non-negotiable and non-refundable. Prize may not be sold, offered for sale or used in connection with any other competition or promotion by the Prize Winner.

36. Prize details are correct at the date of this Agreement.  Events may occur that render the Media Promotion itself or the awarding of Prizes impossible due to unforeseen circumstances or reasons beyond the control of Warner.  In this situation, Warner may at its discretion vary or amend the Prize so as to provide a reasonable alternative prize and the Prize Winner agrees that no liability shall attach to Warner or parties connected to Warner as a result.
