Terms & Conditions for the Time Out Ad-Free Service

These terms and conditions ("Terms") govern your access to the Time Out Ad-Freeservice ("Ad-Free Service") on timeout.com (the "Website"). By purchasing the Ad-Free Service, you agree to be bound by these Terms.

We may revise these Terms at any time by updating this posting. We'll let you know about any big changes with an email or a clear notice on the Website. If you keep using the Ad-Free Service after these changes, that means you accept the new Terms.

1. Information About Us

The Website and the Ad-Free Service are operated by Time Out England Limited and affiliated companies owned by Time Out Group Plc ("Time Out", "we", "us", "our"). Time Out England Limited is registered in England and Wales under company number 01782049, whose registered office is at 1st Floor, 172 Drury Lane, London, WC2B 5QR, United Kingdom. Time Out’s VAT number is GB 672 1770 31.

2. Ad-Free Service

This Ad-Free Service gives you an improved browsing experience on the Website as it removes certain advertisements and limits tracking technologies for a period of 30 days from the date you purchase the Ad-Free Service (“Access Period”).

  • "Ad-Free": The Ad-Free Service is designed to remove display ads, pop-up ads, and pre-roll video ads that usually show up within the editorial content areas of our Website during your Access Period. 
    • Important Clarification: This Ad-Free Service doesn't remove Time Out's own curated editorial content, which might include sponsored listings, native articles, or affiliate links to events and products that we genuinely recommend. These are part of our core editorial offering, are clearly marked where needed, and aren't considered third-party advertisements.
  • "Tracking-Free": When we say "tracking-free," it means we won't use cookies, pixels, or similar technologies to collect your personal data for the purpose of showing you targeted ads or sharing it with third-party advertising partners during your Access Period.
    • Data for Functionality & Improvement: Please know that we'll still collect anonymous and aggregated data that's essential for the Website to work properly, for security, to monitor performance, and to understand how people use our content so we can keep making it better. This data collection strictly follows our Privacy Policy and all applicable data protection laws and regulations.  

3. How can I purchase the Ad-Free Service?

  • You will need to click on ‘Manage Cookies’ in the footer, select the ‘Reject & Pay option’, create an account and pay for the Ad-Free Service and then your access to the Ad-Free Service will begin (note only users who have a Spanish IP address can purchase the Ad-Free Service).
  • Access Period: Your access to the Ad-Free Service lasts for the Access Period. This is a one-off purchase, and it won't automatically renew. There are no recurring payments.
  • Billing and Payment:
    • The price for the Ad-Free Service is 2 Euros and is inclusive of VAT if applicable. 
    • If your payment for the Ad-Free Service doesn't go through, we have the right to pause or stop your access until the payment is successfully processed.
  • Price Changes: We can change the price for future offers of the Ad-Free Service at any time.
  • The Ad-Free Service is personal to you and is non-transferable. 

4. Your Personal Data 

When you register an account and purchase the Ad-Free Service, you agree to give us only accurate and complete registration information and to keep it updated if it changes. You must never use another Website user’s account without their permission. You're fully responsible for anyone who accesses the Website using your account, so we suggest you keep your account password secure. You must tell us immediately if you find out about any unauthorized use of your account.

The terms of the Time Out Privacy Policy form part of these Terms. You agree that Time Out can use your personal information as described in and for the purposes set out in the Time Out Privacy Policy. Time Out is the data controller for the purposes of  applicable data protection laws. 

We process personal data we collect from you (like your first name, last name, email address, payment details) for these reasons:

  • To create an account, process your purchase and manage your Ad-Free Service during the Access Period;
  • To send you service-related communications and important updates about the Ad-Free Service;
  • For statistical analysis and market research (using anonymous or aggregated data when possible); and
  • If you give us your specific consent, to send you news about our special events, offers, promotions, and newsletters (you can manage these preferences in your user account and opt out at any time).

5. How the Contract is Formed Between You and Us

Your order for the Ad-Free Service is an offer from us to provide the service. We accept your order when we send you a confirmation email. At that point, a contract is formed between you and us, covering your Ad-Free Service access under these Terms. If your payment is declined, your access won't be activated, and we'll let you know.

By purchasing the Ad-Free Service through the Website, you confirm that: (a) you're legally capable of entering into binding contracts; (b) you're at least 18 years old; and (c) you have a Spanish IP address.

  1. Our Liability 

Time Out is the direct provider of the Ad-Free Service. We're responsible for giving and managing your Ad-Free Service as outlined in these Terms.

Time Out disclaims any and all responsibility or liability under these Terms to the maximum extent permitted by law. To the extent permitted by law, our total liability is limited to the amount paid for the Ad-Free Service.  

7. Consumer Rights and Cancellation

If you're a consumer, your cancellation rights are:

  • Initial 14-Day Cooling-Off Period: For the Ad-Free Service, since it's digital content that starts immediately upon your purchase confirmation (giving you instant ad-free access), you acknowledge and agree that your right to cancel within the initial 14-day cooling-off period (as per the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013) is waived. This happens when you complete your purchase, provided you've given your clear consent for the service to start right away.
  • Cancellation Post-Purchase: Because you get immediate access to this digital content for a fixed, short period (30 days), and because the 14-day cooling-off period is waived with your consent for immediate performance, you don't have the right to cancel or get a refund for the Ad-Free Service once you've started using it.

You may have statutory consumer rights that apply to your Ad-Free Service which cannot be limited, excluded or modified. 

8. Refunds Policy

  • Since access to the Ad-Free Service is provided immediately after purchase, the user expressly acknowledges and agrees to waive their 14-day right of withdrawal, in accordance with the "Real Decreto Legislativo 1/2007" article 103.
  • Therefore, no refunds will be issued once access to the service has begun, unless a technical issue or lack of conformity prevents the user from enjoying the service as agreed, in which case a full refund of the amount paid will be issued.For any refund-related inquiries, please contact our support team at support@timeout.com.

9. Third Party Payment Processing

Time Out uses the services of third-party payment processors, like Braintree, to securely handle payments and reduce fraud risk with card payments. When you purchase the Ad-Free Service via the Website, you'll need to give your card payment information (like your credit card number, address, and expiration date) directly to our chosen payment processor. Time Out won't collect, process, keep, or store your sensitive personal card payment information on the Website.

Our payment processors are PCI-compliant, making sure your payment data is handled securely. These processors might let you store your card payment information during the checkout process for future convenience. For details on how our processors collect and use payment information, we recommend checking their privacy policy. Time Out isn't responsible for any actions or omissions by these third-party payment processors.

10. Ad-Free Service Access, Suspension & Termination

While we try to make sure the Website and Ad-Free Service are available 24 hours a day, we won't be liable if the Website or Ad-Free Service is unavailable at any time or for any period. Access to the Website and Ad-Free Service might be temporarily suspended without notice for system failure, maintenance, repair, or reasons beyond our reasonable control.

In the rare event that Time Out has to stop the Ad-Free Service due to things beyond our reasonable control, we'll provide notice. If this happens mid-way through your Access Period, we'll give you a partial refund for any unused time. However, we won't refund any other costs you might have incurred.

We'll decide, at our sole discretion, if you've broken these Terms. If a breach has happened, we reserve the right to suspend or terminate your access to the Ad-Free Service. 

At the end of the Access Period your access to the Ad-Free Service will terminate. 

11. Other general legal matter

  • Severability. If Time Out delays or fails to enforce any of these Terms, it doesn't mean Time Out has given up its right to do so later.
  • Assignment. Time Out can assign any of its rights and obligations under these Terms, as long as your rights aren't negatively affected.
  • Governing law and jurisdiction. These Terms are governed by the laws of Spain and both parties agree to the exclusive jurisdiction of the courts in Spain.
  • Third parties. No person who isn't a party to these Terms has any rights to enforce any part of these Terms.
