Working with Minor Children in Removal Proceedings: SIJS, Affirmative Asylum, and Issues to look out for in Juvenile Cases

The CLE will discuss practical and ethical issues with working with minor children in immigration removal proceedings. In particular, I will discuss making sure minor clients understand the proceedings being conducted against them, understand any legal contract they are signing, and having an adult in their life who can care for them and be held accountable. I will also discuss common defenses for children in removal proceedings.

Within that discussion I will focus on Affirmative Asylum and Special Immigrant Juvenile cases, including a discussion about whether filing affirmative asylum for children who entered the United States under the age of 18 and have subsequently reached the age of majority is still an option under the new administration. With respect to Special Immigrant Juvenile status I will discuss advanced issues regarding requesting Special Immigrant Juvenile status for children who are about to turn eighteen, and how to avoid Requests for Evidence and Denials in these case types for this vulnerable population.
