[title]Terms of Use: Time Out Market Budapest Card
The use of your Time Out Market Card constitutes acceptance of the following terms (this “Terms of Use” or “Agreement”), which are a legally binding agreement that governs your use of the Time Out Market Card.
The card issuer is Time Out Market Budapest Kft. (or its designated local operating entity), dependent on the location at which you purchased your Time Out Market Card.
General Terms
Time Out Market (“we” or “us” or “our”) issues a Time Out Market Card to you in any amount you decide to load between HUF 500 and HUF 350,000 (or local currency equivalents) as a way to make it easier for you to shop with us when you only have cash to pay at the Time Out Market where you bought the Time Out Market Card. You will not need a Time Out Market Card if you prefer to use your credit card or debit card.
Time Out Market Card may be used only at the authorised concessionaires of the Time Out Market Budapest location where you bought the Time Out Market Card, duly identified on Time Out Market’s website (www.timeoutmarket.com) (the “Participating Concessionaires”). Time Out Markets in other countries or locales besides the Time Out Market Budapest where you bought the Time Out Market Card, or other Time Out Market-branded places, will not accept your Time Out Market Card for payment. The value that you load onto your Time Out Market Card is a prepayment that gives you access to purchase goods and services at the Participating Concessionaires. Present your Time Out Market Card to the cashier at the Participating Concessionaires at the time of purchase and the card’s available balance will be applied toward your authorized purchase and reduced accordingly.
The Time Out Market Card cannot be redeemed for cash, except where required by applicable Hungarian law. Treat your Time Out Market Card as cash. Time Out Market is not responsible for lost or stolen cards or any unauthorized card use. No refunds will be provided on any lost or stolen Time Out Market Card. The value on your Time Out Market Card is not a bank deposit, is not insured by the National Deposit Insurance Fund of Hungary (OBA), nor does it earn interest.
We may modify or terminate this Terms of Use at any time in accordance with local regulations, with notice provided on our website.
Purchasing and Loading Value onto Your Card
You can purchase and load value onto your Time Out Market Card only from us by visiting the Time Out Market Budapest store, at the designated places for that purpose. Due to possible limitations of our systems, please note that funds may not be readily available after loading your Time Out Market Card for immediate use.

Maximum daily limit per card: No more than HUF 700,000 will be associated with any one Time Out Market Card in a single day.

Maximum aggregate daily limit: The total value you may load onto all of your Time Out Market Cards, together with the value of any new Time Out Market Cards that you may purchase, may not exceed HUF 3,500,000 on any given day, subject to applicable local Anti-Money Laundering (AML) regulations.
Fees
No fees will be charged for activation, service, dormancy, or inactivity in connection with your Time Out Market Card.
Expiration and Unredeemed Balances
Your Time Out Market Card and the funds loaded onto it will expire on 31st July. Any unredeemed balances after this statutory period will be handled in accordance with applicable Hungarian laws regarding unclaimed property and obligations.
Limitations on Time Out Market Card
Time Out Market Cards may not be used in connection with any marketing, advertising, or other promotional activities (including without limitation via websites, internet advertisements, email, telemarketing, direct mail, and radio or television broadcasts) without our express prior written consent.

Mandatory identity registration and compliance with local AML (Anti-Money Laundering) laws are required whenever transactions or card loads exceed thresholds mandated by Hungarian and EU law.

Maintaining the confidentiality and security of your Time Out Market Card.
Unlawful Activity with Your Time Out Market Card
You should treat your Time Out Market Card like cash and not disclose your Time Out Market Card information to anyone. If your Time Out Market Card is lost or stolen, anyone who obtains possession of it may use it. You are responsible for all transactions on your Time Out Market Card, including unauthorized transactions, up to the moment you notify us to block the card (if technically feasible).
If we reasonably believe that the use of any Time Out Market Card or Time Out Market Card balance is unauthorized, fraudulent, or otherwise unlawful, we reserve the right not to accept or to limit the use of such card. Time Out Market has no liability to you for any third-party fraud or unlawful activity associated with any Time Out Market Card balance. If Time Out Market discovers any card balance was sourced or derived from fraud or other unlawful means, we may, at our sole discretion, cancel the impacted Time Out Market Card and retain all related balances without notice to you, reporting such incidents to the relevant Hungarian law enforcement authorities if required.
Not Intended for Use by Minors
The Time Out Market Card is not intended for use by anyone under the age of 16 (in alignment with GDPR/local data protection age thresholds for digital consent). If you are between the ages of 16 and 18, or otherwise have limited legal capacity under the Hungarian Civil Code, you may only use the Time Out Market Card under the supervision or with the consent of a parent or legal guardian who agrees to be bound by this Agreement.
Disclaimers and Limits of Liability
Except as expressly provided otherwise in this agreement, or required by mandatory Hungarian consumer protection laws, the Time Out Market Card is provided on an “as is” basis, without warranty of any kind. Time Out Market does not represent or warrant that your Time Out Market Card will always be accessible or accepted due to potential technical or power disruptions beyond our reasonable control.
To the maximum extent permitted by applicable Hungarian law, you agree to limit any claims for damages against us to monetary relief for the actual, direct damages sustained by you as a direct result of any proven failure attributable to us. Such damages shall not exceed the last balance held on your Time Out Market Card at the time the event occurred. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under mandatory Hungarian law.
Assignment
We may assign this Agreement in whole or in part without your consent to an affiliate or successor entity, ensuring that your rights as a consumer are not diminished. You may not assign this Agreement without our prior written consent.
Entire Agreement, Severability, and Construction
This Agreement completely and exclusively states the agreement between you and Time Out Market regarding the Time Out Market Card. In the event any provision of this Agreement is found to be invalid, illegal, or unenforceable under Hungarian law, such provision will be considered eliminated or amended to the minimum extent necessary so that the validity, legality, and enforceability of the remaining provisions will not in any way be affected or impaired.
Dispute Resolution and Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Hungary.
In the event of a dispute arising from or relating to this Agreement or the use of the Time Out Market Card, the parties shall first endeavor to settle the dispute amicably. If you are a consumer, you have the right to turn to the competent Hungarian Arbitration Board (Békéltető Testület) corresponding to your place of residence or the seat of the service provider to resolve the dispute out of court.
Any unresolved controversy, claim, or legal action arising out of or relating to this Agreement that cannot be settled amicably shall be submitted to the exclusive jurisdiction of the competent courts of Budapest, Hungary.
