Receiving the USD $10 off voucher (“Voucher”), constitutes your acceptance of
these Terms and Conditions (“T&Cs”) by and between you (“you”, “your”) and Time Out Market (Boston), LLC (“TOM”, “we”, “our”, “us”).

1. To receive the Voucher, you must enter your email address, agree to Time
   Out’s Terms of Use, Privacy Notice and these T&Cs and consent to receive
   emails from Time Out about news, events, offers and partner promotions. You
   will then receive an email from us containing a link to redeem the Voucher via
   our online ordering tool (GoTab) or at one of the vendors in Time Out Market
   Boston (“Market”).
2. To redeem the Voucher, you must:
   
   • Show the offer code to your chosen vendor in the Market at the time of
     payment, or via online ordering, where the Voucher will be applied
     automatically;
   • Spend a minimum of USD $40 on food (excluding any applicable taxes
     and service fees) to receive your discount; and
   • Enjoy the delicious treats the Market has to offer!
3. The Voucher is for one single use only and cannot be used in conjunction with
   any other offer or promotion or on drinks. The Voucher is not valid for cash or
   store credit and may not be sold or exchanged.
4. The Voucher can only be redeemed at the Market located at 401 Park Dr,
   Boston, MA 02215, United States.
5. The Voucher is valid until 22 October 2025.
6. If the email containing the link to the Voucher is lost or deleted, it will not be
   reissued or refunded.
7. One Voucher per person.
8. TOM reserves the right to modify or amend these T&Cs at any time and
   without prior notice.
9. These T&Cs shall be governed in accordance with the laws of the State of
   New York without regard to its conflict of law principles. The parties hereby
   consent to the exclusive jurisdiction of the courts of New York.
10. THE VOUCHER SHALL BE PROVIDED ON “AS IS” BASIS, WITHOUT
    WARRANTY, REPRESENTATION OR CONDITION OF ANY KIND, AND THE
    ENTIRE RISK AS TO THE RESULTS AND PERFORMANCE THEREOF IS
    ASSUMED BY YOU. TOM AND ITS AFFILIATES EXPRESSLY DISCLAIM
    ANY WARRANTIES THAT THE VOUCHER WILL ALWAYS BE ERROR-
    FREE, ACCESSIBLE OR ACCEPTED.
11. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE TO LIMIT
    ANY CLAIMS FOR DAMAGES AGAINST TOM TO MONETARY RELIEF FOR
    THE ACTUAL DAMAGES SUSTAINED BY YOU AS A DIRECT RESULT OF
    ANY PROVEN FAILURE IMPUTABLE TO US, PROVIDED THAT SUCH
    DAMAGES SHALL NOT EXCEED THE AMOUNT OF THE VOUCHER. THIS
    LIMITATION AND WAIVER WILL APPLY TO THE MAXIMUM EXTENT
    PERMITTED BY LAW REGARDLESS OF THE THEORY OF LIABILITY.
     THAT MEANS YOU WILL NOT TRY TO GET ANY INDIRECT, SPECIAL,
    CONSEQUENTIAL, TREBLE OR PUNITIVE DAMAGES FROM US,
    EXCEEDING THE AMOUNT OF THE VOUCHER.
