Massachusetts happy hour ban could be over soon

Drink specials could be returning to Boston after nearly 40 years.

Happy Hour” has been banned in Massachusetts since 1984 over concerns about drunk driving. But that could be changing soon in cities like Boston and Provincetown.

On Thursday, the Massachusetts State Senate voted to add an amendment to their $4.57 billion economic development bill, that reads: “In a city or town that accepts this section in the manner provided in section 4 of chapter 4, an establishment holding a license to sell alcohol to be drunk on the premises shall be permitted to sell alcoholic beverages or alcohol at a discounted price, in a manner as approved by the city or town.”.

Essentially, this would mean that each city and town in Massachusetts could choose to allow happy hour if they wanted. The state law would ensure that promotions would only be allowed during certain hours and would need to be planned at least three days in advance—so still no last-minute drink deals.    

The amendment was filed by Sen. Julian Cyr of Truro and in response to the drunk driving concerns he told WBUR, “You look at Provincetown, certainly we want to avoid any people getting into cars — well, you don't really need to get in the car and often don't get in a car when you're in Provincetown. You really are able to walk around and stay out of your vehicle. If you're in Boston, you have options, whether it be the T — as long as it doesn't burst into flames — or ride-sharing."

While this amendment has made it to the Senate version of the economic development bill it still needs to be agreed to by the House if it is to move forward. House Speaker Ron Mariano is expected to be open to discussing happy hour but has yet to stand in favor or against it. The real hurdle is most likely Gov. Charlie Baker. Last summer he said he would be "hard-pressed" to support the return of happy hour in Massachusetts because he personally remembers the deadly drunk driving accidents of the 80s.

Many residents want to see happy hour back in Boston. A MassINC poll from 2021 showed 70% of residents in favor of happy hour, due largely to the availability of ride-share apps to help keep people from drunk driving. But we will have to continue to wait and see what happens.
