Survey Official Rules

Introduction
This Time Out Survey gives the Competition entrants the opportunity to win one $200 OpenTable gift card. The details of the Prize (as defined below) and how to enter the Competition are contained in these Official Rules.

To Enter
You can enter the Competition online. During the Promotion Period (as defined below), go to the Competition page and complete the online entry by entering true and correct information in all of the fields, click to submit, and you will automatically receive one entry in the Competition. Electronic entries will be deemed made by the authorized account holder of the e-mail address submitted at time of entry. The "authorized account holder" is deemed to be the natural person who is assigned to a particular e-mail address by the applicable Internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be requested to provide Sponsor (as defined below) with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry. Limit one (1) entry per person and per e-mail address. More than one (1) entry from any person or from any e-mail address will void all entries from that person or e-mail address, as applicable. Any attempt by a person to enter more than once with multiple email accounts may result in disqualification at the discretion of the Sponsor upon verification of potential winners.

By participating in this contest, entrants agree to receive promotional emails from Time Out. Time Out ("Sponsor") and OpenTable (with Sponsor hereinafter, “Promo Partners”) are not responsible for lost, late, incomplete, garbled, illegible, or misdirected Competition entries, or for any error, human, technical or otherwise, which may occur in the processing of Competition entries. Proof of sending will not be deemed to be proof of receipt. All entries become the exclusive property of Sponsor and will not be acknowledged or returned. Any use of robotic, automatic, programmed or similar entry methods will void all such entries by such methods.

Alternate Method of Entry
To enter without registering to receive promotional e-mails from Time Out, send a 3x5 card with your full name, e-mail address & phone number to “Time Out Survey”, Time Out, 475 Tenth Avenue, 12th floor, New York, NY 10018. Mail-in entry must be received by March 25, 2015 in order to be eligible.

Timing
The Competition begins at March 20, 2015 (the "Promotion Period"). Online entries received prior to or after the Promotion Period are disqualified.

Eligibility
The Competition is open only to legal residents of the forty-eight contiguous states in the United States and the District of Columbia (excluding Puerto Rico, Alaska, and Hawaii) who are 18 years of age or older at time of entry.

Agreement to Official Rules
Participation in the Competition constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules and to be contacted by email and/or telephone by Sponsor.

Selection of Potential Winner
One (1) potential winner will be determined by a random drawing to be conducted by Sponsor on or about April 1, 2015, from among all eligible entries received. Sponsor's decisions as to all matters related to administration of the Competition and selection of potential winner is final. All potential winners must comply with all terms and conditions set forth in these Official Rules, and winning is contingent upon fulfilling all requirements. The potential winner from the drawing will be notified by email on or about May 13, 2015. If the potential winner does not respond within 3 days of notification, an alternate entrant will be selected in his or her place at random from all eligible entries received. If three (3) alternate potential winners are selected without successfully securing an eligible winner, the Prize may go unawarded. Winner (as defined below) and Winner's guest may be required to sign and return an Affidavit of Eligibility and a Liability Release within seven (7) days following the date of first attempted notification. Failure to comply with this deadline may result in forfeiture of the prize and selection of an alternative winner.

Prize
The grand prize Competition winner (the "Competition Winner" or "Winner") will be awarded one prize (the “Prize”) consisting of:

ARV: $200. If actual value of Prize is lower than the stated ARV, any difference in the value will not be awarded. Black out dates may apply.

The Prize is subject to the following material conditions and restrictions:
NO CASH OR OTHER SUBSTITUTIONS ARE PERMITTED, EXCEPT BY SPONSOR, WHO RESERVES THE RIGHT TO SUBSTITUTE THE PRIZE WITH ONE OF EQUAL OR GREATER VALUE.

All federal, state and local taxes related to the Prize are the sole responsibility of the Competition Winner. All other expenses and costs not expressly listed in the Prize description above, including but not limited to, additional food and beverages, gratuities, additional travel, entertainment, ground transportation, and applicable taxes (including any income taxes on the value of the Prize), are the Competition Winner’s sole responsibility. No transfer of the Prize is permitted. If for any reason winners are unable to use prizes within the time specified, the participating organizations are not responsible for providing replacement prizes. No make goods will be given in the event of a canceled or rescheduled event. Time Out does not endorse or make any representation about the prize or quality of the services that are part of the prize.

Return of any prize notification as undeliverable may result in disqualification and selection of alternate winners.

Odds of Winning
The odds of winning depend on the number of eligible entries received.

General Conditions
The Competition is governed by the laws of the United States and the State of New York, and participants in the Competition hereby consent to the exclusive jurisdiction and venue of New York courts (state and federal) for any causes or controversies arising out of the Competition. Each participant waives any and all objectives to jurisdiction and venue in these courts. Neither Promotion Partners nor entrant will have the right to participate in a representative capacity on behalf of the general public or other persons similarly situated, or as member of any class of claimants, pertaining to any claim. All applicable federal, state and local laws and regulations apply. Void where prohibited. Competition may only be entered in or from the United States and entries originating from any other jurisdiction are not eligible for entry.

Except where prohibited by law, the Winner and Guests grant to Sponsor, the Promo Partners, and their agencies the right to use and publish their photos, proper names, likeness, voices, opinions, biographical information and state of residence in any media to promote Sponsor, the Promo Partners, and the Competition without additional compensation.

By entering, participants release and hold harmless Sponsor, the Promotion Partners, Time Out, and each of its and their subsidiaries, affiliates, directors, officers, employees and agents from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the Competition, including, without limitation, the offer to enter, entrant’s participation, and/or the receipt or use and/or misuse of the Prize.

Sponsor reserves the right to cancel or modify the Competition if fraud or any other factor impairs the integrity of the Competition as determined by Sponsor in its sole discretion. 


If, in the Sponsor's opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Competition, or if technical difficulties compromise the integrity of the Competition, the Sponsor reserves the right in its sole discretion to void any entries at issue (including disqualifying any individual who tampers with the entry process), and to cancel, terminate, modify or suspend the Competition, in whole or in part, at any time without notice. In the event of such cancellation, Sponsor reserves the right to award prizes in a random drawing from all eligible entries received before the time of cancellation. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction of unauthorized access to, or alternation of, entries. Neither the Promo Partners nor Sponsor is responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry received by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site, any combination thereof, or otherwise, including any injury or damage to entrant's or any other person's computer related to or resulting from participation or downloading any materials in the Competition.

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

Competition results and copy of these Official Rules may be obtained by sending a self-addressed, stamped envelope to: Time Out survey, Time Out America LLC, 475 10th Ave 12th Floor, New York, NY 10018 (Vermont residents may omit return postage). Results will be available after May 13, 2015. Requests for results must be received by June 1, 2015.
