1. These Terms

Please read the below Terms and Conditions (“the Terms”) carefully before purchasing a Time Out Gift Box from the website http://checkout.timeout.com/london (the “Website”). By purchasing your Time Out Gift Box you are entering into a contract and agreeing to be bound by these Terms. Time Out reserves the right to amend these Terms at any time and will display the amended terms on the Website. You will be bound by the terms and conditions that appear on the Website at the time of your purchase. These Terms are to be read in conjunction with our  privacy policy https://www.timeout.com/privacy-notice (“Privacy Notice”) and the Website terms of use https://www.timeout.com/terms-of-use  (“Terms of Use”). 

2. About Us

The Time Out Gift Boxes are provided by Time Out England Limited company number a company registered in England and Wales company number 01782049 with registered office at 1st Floor, 172 Drury Lane, London, WC2B 5QR. We can be contacted at offers@timeout.com (“Time Out/our/us/we”). Time Out’s VAT number is 135615325.

3. The Time Out Gift Boxes

Unless otherwise specified at the time out purchase on the landing page, the Time Out Gift Boxes contain five (5) digital QR codes which will entitle the purchaser (“you”) to 50% off at a selection of restaurants across London, United Kingdom (the “Cards”), with one (1) Card per participating restaurant (“Time Out Gift Boxes”) for a maximum of two (2) diners per booking at any one time. The Cards will not be accepted by restaurants for any bookings over the maximum of two people. These prices include VAT but do not include any applicable service charge that may have imposed by the participating restaurant. Offers, benefits and discounts are provided by participating restaurants, venues and event organisers (“Time Out Partners”) and are available from the Website. 

4. Our Contract with You

We will accept your order of a Time Out Gift Box when you receive a payment confirmation email from us, at which point a contract will come into existence between you and us. If payment is declined, you will be notified.

5. Term and Renewal

The Time Out Gift Box is valid for the dates specified notified to you via confirmation email at the time of purchase (the “Validity Period”) The Time Out Gift Box cannot be used before or after the Validity Period. 

6. Delivery

Once you place an order for a Time Out Gift Box and have provided Time Out with your email address, your digital cards will be sent to you via email. 

7. Price and payment

The price of the Time Out Gift box is as stated on the Website at the time of purchase and is subject to change from time to time. Any price changes by us will not affect orders in respect of which we have already sent you confirmation. Payment can be made by all major debit and credit cards or other methods we may agree, as detailed on the Website and there are no additional card charges payable. All prices include VAT. 

8. Third Party Payment Processing

Time Out uses the services of a third-party payment module named Paypal.com (“PayPal”) to process payments securely and limit fraud in connection with credit card transactions or other payment methods through its tokenization solution. When purchasing a Time Out Gift Box, you will be required to disclose personal payment information (e.g. credit card number, address, expiration date, etc.) to PayPal. Time Out will not collect, process, keep or store your personal payment information on the Website. The PayPal solution is fully PCI-compliant because it stores a secure token as a reference to the credit card data. PayPal allows customers to store their payment information during the checkout process for future use, giving returning customers the convenience of stored credit cards and rapid checkout. Time Out shall not be liable for any actions or omissions of PayPal.

9. Cancellation 

You have 14 days from placing your order to cancel your Time Out Gift Box. Cancellation requests should be sent directly to offers@timeout.com, and you may use the Model Cancellation Form found below. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees because of the reimbursement.

10. General Card Terms

The Cards offer a 50% discount only on food for two people, excluding all drinks consumed in the selected restaurants. The Cards are not compatible with any other discounts, including discounted menus that the Merchant may offer and set menus, specials boards, holiday menus, cultural celebrations or special event menus (including, without limitation, Valentine’s Day, Mother’s Day, Father’s Day, New Years Eve and New Years Day). To be able to enjoy this discount, it is mandatory to deliver the respective restaurant card upon request of the bill. In each of the participating restaurants it will be possible to use a maximum of 1 Card per table for a maximum of two (2) diners per booking at any one time. The Cards will not be accepted by restaurants for any bookings over the maximum of two people. The holder of the Card will be like any client subject to the availability of spaces at the restaurants. No reference to the promotion needs to be made when making a reservation. The Card will only be accepted if presented in perfect condition and not showing evidence of damage or duplication. In the event of non-use, theft or destruction of the cards, the beneficiary is not entitled to any refund or compensation of any nature whatsoever.

Cards are valid on all days of the week including holidays and weekends (with the exception of the last two weeks of December of any calendar year) subject always to availability at the participating restaurants. Time Out and the distributor can never be held responsible for a lack of availability or capacity at participating restaurants. The participating restaurants are solely responsible for the good execution of the service. It is the exclusive responsibility of the Card holder to provide them to the participating restaurants. Time Out and the distributor are not responsible for any changes that may occur during the period of validity of the offer, namely the closure of any of the restaurants, address changes, name changes or other modifications that cannot be foreseen during the production of the Time Out Gift Box.

11. Liability

Our liability to you if we fail to comply with these Terms, is limited to amount paid by you for the Time Out Gift Box. Time Out will not be responsible for any indirect losses, consequential, exemplary, special or punitive damages, lost opportunities, loss of profits, anticipated profits, actual or anticipated savings even if Time Out has been advised of the possibility of such damages. We do not limit our liability at law for fraudulent misrepresentation or for death or personal injury caused by negligence or any other type of liability which cannot by law be excluded or limited. We do not accept liability for unsatisfactory experiences or any failure by our Partners to deliver expected services and quality. Any complaints should in the first instance be taken up directly with the relevant Time Out Partners and thereafter Time Out will endeavour to investigate any unresolved problems.

You agree to hold us harmless against all losses, liabilities, claims or demands arising out of any breaches of the representation and warranties and assurances. We reserve the right to vary, amend or cancel this promotion at any time and you agree that no liability shall attach to us as a result thereof. 

Information supplied by Time Out Partners is believed to be correct at the time of going to print/availability on the Website and we cannot accept responsibility for any inaccuracies or discrepancies contained within such information. Time Out shall not be responsible for omissions or typographical errors.

Time Out shall be entitled to assign its rights and obligations under this Agreement provided your rights are not adversely affected. No third party or person who is not a party to these Terms shall have any rights as against Time Out and neither you or we intend any third party to be able to enforce any of these terms pursuant to the Contract (Rights of Third Parties) Act 1999. Our contract with you is governed by the Laws of England and Wales and the Courts of England. 

12. Use of Personal Data and Data Protection

The terms of the Time Out Privacy Policy are incorporated into these Terms. You agree to the use of your personal information by Time Out in accordance with the terms of and for the purposes set forth in the Time Out Privacy Policy which can be found at http://www.timeout.com/london/privacy-policy . Time Out England Limited is the data controller for the purposes of the Data Protection Act 1998 and is registered with the Information Commissioner Office under registration number ZA078189. By purchasing a Time Out Gift Box you consent that we may process personal data that we collect from you in accordance with our Privacy Policy (which may be varied from time to time), the Data Protection Act 2018 and the General Data Protection Regulation 2016/679.

Time Out may use all the information that you supply to us in purchasing a Time Out Gift Box (such as your name, address, email address, telephone number etc) for the purposes of:

administering the membership;

statistical analysis;

sending you news of our special events, offers, promotions and newsletters either by post, email, SMS or through any social network that related to the Time Out Gift Box;

market research.

We reserve the right to vary or amend the Privacy Policy from time to time at our sole discretion and you will be bound by the version that appears on the Website at any given time. Any amendments to the Privacy Policy will be reflected on the website and we recommend that you visit our website from time to time keep up to date with any amendments.

You can manage your preferences via your user account (which you can create and view) at www.timeout/london and opt out of receiving the communications as specified above at any time. If you have any concerns you can contact privacy@timeout.com

Time Out uses the services of a third-party company located in the EEA to process your personal details for the purpose of providing you with the Time Out Gift Box (these details include your name, email address and physical address. Time Out has assessed the security of the third party as being adequate and has entered into relevant agreements accordingly. Time Out does not transfer your personal data outside of the European Economic Area. We do not share or sell your personal data to third parties other than as specified above.

All questions and any complaints should be directed to offers@timeout.com . We will attempt to respond to your correspondence within 3 working days.
